ACGGOODS Term of Service

Welcome to ACGGOODS! These Terms of Service (“Terms”) govern your use of our website, platform, and services (collectively, the “Site”). By accessing or using ACGGOODS, you agree to be bound by these Terms, as well as our Privacy Policy and Copyright Policy. Please read them carefully. If you do not agree, please do not use the Site.
1. Overview
ACGGOODS operates as a POD platform. Our platform allows independent creators to upload original designs for merchandise, which we then manufacture and fulfill on their behalf. Additionally, we facilitate a specialized YCH (Your Character Here) Merch Commission service, connecting Artists with Commissioners for custom digital artwork that is directly fulfilled as physical merchandise. ACGGOODS strictly provides the print-on-demand technology, logistics, storefront infrastructure, and escrow services.
2. Account Registration
To open a store and sell on ACGGOODS, you must create a registered account. When registering, you agree to provide accurate, current, and complete information and to update it as needed. You are solely responsible for all activities that occur under your account and for maintaining the confidentiality of your account credentials.
To purchase merchandise, you may choose to create an account or use our Guest Checkout option. Please note that if you place an order as a guest, your order history and purchasing data cannot be linked, transferred, or synced to any registered account created at a later date.
3. Eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use ACGGOODS. By using our platform, you confirm that you meet this requirement and are legally capable of entering into a binding contract.
4. Creator and Seller Agreement
If you register as a Creator or Seller on ACGGOODS, you agree to the following:
Ownership & Licensing: You retain full 100% ownership of your original artwork and characters. By uploading designs, you grant ACGGOODS a non-exclusive, worldwide, royalty-free license to use, modify (for printing purposes), reproduce, and distribute the artwork solely for the purpose of fulfilling, and marketing your merchandise.
YCH Merch Commission Obligations: For YCH Commissions, the Artist is strictly responsible for preparing and delivering high-resolution digital artwork files suitable for physical production. Artists must respect and comply with their own published creative boundaries, including “Blacklists” or “Will Not Draw” (WND) terms.
Delivery & Strikes (YCH Only): Artists must deliver artwork within their stated timeframe. If an Artist fails to deliver within the Platform deadline of ninety (90) days, a 100% refund may be issued to the Commissioner. Failure to fulfill YCH delivery obligations will result in:
1st Violation: Official warning.
2nd Violation: Formal warning and temporary suspension of YCH Merch Commission privileges until all outstanding orders are completed.
3rd Violation: Permanent removal from the YCH Merch Commission program.
Originality & Compliance: You warrant that all uploaded content is your original, human-made creation. You agree to strictly adhere to our Copyright Policy, including our absolute prohibition on AI-generated content.
Indemnification: You are fully responsible for ensuring your content does not infringe upon any third-party intellectual property rights. You agree to indemnify and hold ACGGOODS harmless from any claims, damages, or legal fees arising from copyright or trademark infringement related to your uploaded designs.
Platform Rights: ACGGOODS reserves the right to reject, remove, or permanently ban accounts and content that violate our guidelines or generate DMCA takedown notices, without prior warning.
5. Pricing, Payments, and Financial Liability
Standard Store Earnings: Product base prices and minimum commission rates are determined by ACGGOODS. Payouts are issued via PayPal processors from 15th of each month.
YCH Escrow Protocol: For YCH Merch Commissions, the Commissioner must remit 100% of the project fee (inclusive of shipping and tier surcharges) at the time of booking. These funds are held in escrow by the Platform. Earnings (including both digital artwork fees and physical product proceeds) will only be released to the Artist’s account for standard settlement after the associated physical order has been successfully delivered to the Commissioner.
Tax Responsibility: Sellers are responsible for any applicable transaction fees or local taxes.
Financial Liability: In the event of a valid DMCA copyright claim, fraud, chargebacks, or significant refund requests, ACGGOODS reserves the right to withhold payouts, deduct legal/processing costs, or process refunds directly from the seller’s unsettled earnings.
6. Order Fulfillment & Quality Assurance
Production & Timelines: ACGGOODS handles all backend production, packaging, and global shipping. Estimated production time is 5-7 business days. For YCH Commissions, manufacturing is initiated immediately upon the Commissioner’s formal approval of the final digital artwork; no physical prototype photographs are provided.
Manufacturing Variations: Minor discrepancies in color (digital screen to physical print) and inherent manufacturing artifacts (e.g., slight offsets in acrylic laser-cutting) are considered acceptable industry tolerances and do not qualify for a full refund or replacement.
Logistics: We are not liable for delivery delays caused by logistics providers, weather, or international customs.
7. Returns, Refunds, and Cancellations
All physical products are custom-made-to-order. We do not accept returns or exchanges for a change of mind.
Standard Orders & Physical Defects: If an order arrives damaged or contains a manufacturing defect, contact support@acggoods.com within 7 days of delivery with photos for a resolution. For YCH Commissions, the Commissioner is strictly prohibited from contacting the Artist regarding manufacturing defects or logistics issues.
YCH Commission Cancellations:
Before Commission Acceptance: If declined by the Artist, the Commissioner receives a 100% refund. If canceled by the Commissioner before acceptance, non-refundable transaction fees may apply.
After Acceptance / Before Artwork Approval: Purchases are deemed final. However, a mutual agreement for a partial or full refund may be reached between the Artist and Commissioner, subject to Platform review and non-refundable transaction fees.
After Artwork Approval: The order automatically enters physical production. No refunds shall be permitted for the Commission.
8. Intellectual Property of the Platform
All structural intellectual property on the Site—including but not limited to the ACGGOODS name, logos, website design, text, and graphics (excluding user-uploaded artwork)—belongs to ACGGOODS. Unauthorized use, reproduction, or scraping of our platform data is strictly prohibited.
9. Prohibited Activities
While using the Site, you agree NOT to:
Upload infringing, unauthorized, or AI-generated artwork.
Upload offensive, hateful, defamatory, pornographic, or illegal content.
Misrepresent your identity or falsely claim ownership of artwork you did not create.
Circumvent our platform’s pricing, fulfillment, or payout systems.
Use the Site to distribute malware, spam, or engage in fraudulent activities.
Violation of these rules will result in immediate account suspension, forfeiture of earnings, and potential legal action.
10. Governing Law and Dispute Resolution
We may update these Terms occasionally to reflect operational or legal changes. Continued use of ACGGOODS after such changes constitutes your acceptance of the revised Terms. We will notify users of significant updates via email or platform notice.
These Terms, and any disputes arising from them, shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.
