ACGGOODS Copyright Policy

1. General Principles
ACGGoods is a platform for independent artists. All designs and copyrights are uploaded by users. We prioritize manual artistry and strictly accept designs that are original, human-made, and legally authorized. The platform reserves the right to review, remove, or terminate collaborations at any time if an IP violation is suspected.
2. Standards of Originality and “No AI” Policy
ACGGOODS is a human-centric platform dedicated to authentic creativity. Any form of AI-generated content is strictly prohibited across all services, including standard POD stores and YCH Merch Commissions.
Prohibited AI Use: Selling AI-generated images, AI-assisted tracing, or using AI models/algorithms for structural generation at any stage of the creative, rendering, or manufacturing process.
Tracing & Referencing: 1:1 tracing of third-party images is prohibited. All final lines and colors must be manually executed by the artist.
Enforcement: Any Artist found in violation of this AI prohibition will face immediate and permanent account termination. All active funds held in escrow for said Artist will be refunded to the respective Commissioners in full.
3. Artist’s Warranties and Responsibilities
Artists must retain layered source files (e.g., PSD, Procreate) and progress records. In the event of a copyright inquiry or DMCA Counter-Notice, the artist must provide these files within 48 hours. Any claims or liabilities arising from copyright issues shall be borne solely by the artist.
4. Commission Licensing & Derivative Works
Derivative Compliance: Derivative works must stay within “Fair Use” or the allowed scope of the respective IP holder. Fan art violating specific prohibitions will be removed immediately.
YCH Merch Commission Licensing Tiers: The Artist retains the original copyright to the commissioned artwork. The Commissioner’s usage rights are strictly determined by the Tier selected at checkout:
Personal: Non-exclusive, non-transferable license for private use only (social media display, personal printing). Any form of monetization or commercial exploitation is prohibited.
Monetized Content: Includes all Personal Use rights, plus the right to utilize the artwork in monetized digital media (e.g., YouTube/Twitch streaming assets, VTuber content). This tier does not permit the manufacturing of physical goods for resale.
Commercial Merch: Grants a commercial license allowing the Commissioner to use the design for mass production, branding, and resale.
5. Prohibited Content
Immediate takedown applies to uploads containing: infringement of copyrights/trademarks; unauthorized use of brand logos/game characters; AI-generated works; or content involving political propaganda, pornography, hate speech, or violence.
6. DMCA Copyright Policy & Reporting Procedure
ACGGoods complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyright has been infringed, we have established the following procedure to ensure swift resolution.
6.1 Submitting a DMCA Takedown Notice
To report an infringement, please send a written DMCA Notice to our Designated Copyright Agent at copyright@acggoods.com.
To ensure your report is valid and processed immediately, your notice must include:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the infringing material with enough detail so we can locate it on the site (e.g., a direct URL to the product/design).
- Your contact information, including your name, address, telephone number, and email address.
- A statement of good faith that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement made under penalty of perjury that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
Note: If evidence is incomplete, the report may be rejected. Valid notices will result in immediate takedown of the infringing content.
6.2 Submitting a DMCA Counter-Notice (Artist Appeal)
If your artwork was removed due to a DMCA notice and you believe this was a mistake or you hold the rights to the work, you may submit a Counter-Notice to copyright@acggoods.com within 7 business days.
Your Counter-Notice must include:
- Identification of the material that was removed and its previous location (URL).
- Your contact information (name, address, telephone number, and email).
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Proof of Originality: Layered source files, creation timelines, and drafts to prove originality as outlined in Section 3.1.
- A statement that you consent to the jurisdiction of the courts of the Hong Kong SAR (or the federal district court for your address if in the US), and that you will accept service of process from the person who provided the original DMCA notice.
- Your physical or electronic signature.
6.3 Final Decision
Upon receiving a valid Counter-Notice and proof of originality, ACGGoods will forward it to the original reporter. If the reporter does not notify us within 10-14 business days that they have filed an action seeking a court order to restrain the artist, the removed material may be restored. If no Counter-Notice is filed, or the appeal fails, the product will be permanently removed.
7. Repeat Infringer Policy (The “Two-Strike” Rule)
In accordance with the DMCA, ACGGoods has adopted a policy of terminating accounts of users who are deemed to be repeat infringers.
7.1 First Violation
The infringing product is permanently removed, and a Formal Warning is issued to the artist’s account.
7.2 Second Violation
The artist’s account and store will be permanently banned without the possibility of further appeal.
8. Platform Usage Rights
8.1 Marketing Rights
Artists grant ACGGoods the right to use submitted works for promotional purposes (e.g., website mockups, social media, digital ads).
8.2 Scope
The platform will never resell original artwork files or use them outside the agreed scope of collaboration.
8.3 Ownership of Original Characters
For works featuring original characters (OCs) created by the artist including products or events featured on the ACGGoods main page, the artist retains 100% ownership and all associated intellectual property rights. ACGGoods makes no claim of ownership over user-created original characters. Our featuring of these works serves solely as a promotional showcase and does not constitute any transfer of IP rights.
9. Governing Law and Dispute Resolution
9.1 Jurisdiction
This policy is governed by the laws of the Hong Kong Special Administrative Region.
9.2 International Standards
Both parties shall comply with international conventions, including standard DMCA procedures for copyright enforcement as outlined in Section 6.
9.3 Dispute Resolution
Disputes shall first be resolved through good-faith negotiation. If unresolved, they shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong SAR.
