1. General Principles
- Human-Made & Self-Created: ACGGOODS only accepts designs that are original, human-made, and legally authorized. We prioritize the value of manual artistry and independent creative processes.
- Compliance: All artworks and related materials submitted must not infringe upon any third-party intellectual property rights, trademarks, publicity rights, or other legal rights.
- Platform Authority: The platform reserves the right to review, remove, or terminate collaborations at any time if a violation is suspected or confirmed.
2. Standards of Originality and “No AI” Policy
To protect the integrity of our creative community, ACGGOODS maintains strict standards regarding how a work is produced:
- Strict “No AI” Policy: Any form of AI-generated content is strictly prohibited. This includes:
- Directly selling AI-generated images.
- AI-Assisted Tracing: Tracing, inking, or painting over an AI-generated base.
- AI Structuring: Using AI to generate compositions, poses, or structures as the primary “skeleton” of a work.
- Tracing and Referencing:
- Permitted: Using original photography taken by the artist as a reference for poses, anatomy, or lighting.
- Prohibited: 1:1 tracing or “over-referencing” of third-party images (including but not limited to Pinterest, Google, social media, or stock photos not owned by the artist).
- Manual Effort Requirement: All final lines and colors must be manually executed by the artist.
3. Artist’s Warranties and Responsibilities
- Proof of Process: Artists are required to retain layered source files (e.g., PSD, Procreate, SAI) and progress records (sketches, drafts, or timelapses). In the event of a copyright inquiry, the artist must provide these files within 48 hours.
- Liability: Any claims or liabilities arising from copyright or trademark issues shall be borne solely by the artist. ACGGOODS reserves the right to deduct legal costs and refund expenses directly from the artist’s unsettled earnings.
- Exclusivity: For “collaboration works,” artists must notify the platform before selling them elsewhere. The platform reserves the right to require differentiated sales or exclusivity.
4. Fan Art and Derivative Works
- Compliance with IP Owners: Artists must respect the guidelines of original copyright holders (IP owners). Derivative works must stay within the “Fair Use” or allowed scope of the respective IP.
- Unauthorized Works: Fan art that violates the specific prohibitions of an IP holder or involves tracing of official/other fan art will be removed immediately.
5. Prohibited Content
The following content is strictly prohibited and will result in immediate takedown:
- Works infringing on copyrights, trademarks, or publicity rights.
- Works using brand logos, game characters, or celebrity likenesses without authorization.
- AI-generated or AI-derived works.
- Traced works based on third-party copyrighted materials.
- Content involving political propaganda, pornography, hate speech, or violence.
6. Complaint and Takedown Procedure
- Preliminary Review: Upon receiving a complaint with valid evidence (e.g., overlay comparisons), the platform will conduct a review within 3 business days and may temporarily hide the product.
- The “Two-Strike” Rule:
- First Violation: The product is removed, and a Formal Warning is issued to the artist.
- Second Violation: The artist’s account and store will be permanently banned and terminated without further appeal.
- Appeal Window: Artists have 7 business days to provide valid evidence (source files/original reference photos). Failure to respond will result in a final takedown decision.
7. Platform Usage Rights
- Marketing Rights: Artists grant ACGGOODS the right to use submitted works for promotion and marketing (product mockups, social media ads, trade shows, etc.).
- Scope: The platform will not resell the artwork files or use them outside the scope of the agreed-upon collaboration.
8. Governing Law and Dispute Resolution
- Jurisdiction: This policy is governed by the laws of the Hong Kong Special Administrative Region.
- International Standards: Both parties shall also comply with applicable international conventions, including DMCA Takedown procedures where applicable.
- Dispute Resolution: Disputes shall first be resolved through negotiation. If unresolved, they shall be submitted to the courts of the Hong Kong Special Administrative Region.
